Terms of Service

Welcome to Greenao. These Terms of Service ("Terms") explain your rights and responsibilities when you use the Greenao mobile app, website, and related services (collectively, the "Service"). By creating an account, downloading the app, or using the Service, you agree to these Terms.

If you do not agree, do not use the Service.

1. Eligibility and Account Use

• You must be at least the age of digital consent in your region, and at least 13 years old (or older where local law requires).
• If you are under the age of majority in your region, you may use the Service only with permission and supervision of a parent or legal guardian.
• You are responsible for maintaining the security of your account credentials and for all activity under your account.

2. What Greenao Provides

Greenao helps you identify plants using an AI scan feature and provides related app functionality. Service features may change over time, including feature additions, removals, or modifications.

3. Required Service Facts

• Supabase is used for user authentication.
• RevenueCat is the subscription handler.
• Supabase also stores RevenueCat webhook events.
• OpenAI is used to identify plants in AI scan feature.
• Cloudflare R2 is used to temporarily upload scan photos and these photos are removed right after scan finishes.
• No other user data is stored server-side; user content and plant data live on the user's device.

4. Subscriptions, Billing, Renewal, and Cancellation

• Purchases are billed through Apple App Store or Google Play, based on your device platform.
• Subscriptions automatically renew unless canceled before the renewal date according to Apple or Google rules.
• Pricing, trial eligibility, renewal cadence, and taxes are shown in your app store purchase flow.
• You manage, downgrade, or cancel subscriptions through your Apple or Google account settings (not directly in Greenao).
• RevenueCat is used to process subscription status and entitlements for the app.
• Refunds are handled by Apple or Google under their respective policies, unless local law requires otherwise.

5. Acceptable Use

You agree not to:

• Violate any law, regulation, or third-party rights.
• Attempt unauthorized access to the Service or related systems.
• Interfere with app operation, security, or integrity.
• Use bots, scraping, reverse engineering, or exploitative automation except where law explicitly allows.
• Upload malicious code, harmful content, or material you do not have rights to use.
• Use the Service in a way that could harm others, including misuse of plant identification outputs.

6. AI Output and Professional Advice Disclaimer

Greenao scan results are generated by AI and may be incomplete, incorrect, or outdated.

• The Service is for informational purposes only.
• Greenao does not provide professional horticultural, botanical, agricultural, toxicology, medical, veterinary, or emergency advice.
• Do not rely on Greenao as your sole basis for plant safety, edible use, pet safety, medical decisions, or treatment decisions.
• For critical decisions, consult a qualified professional.

7. Intellectual Property

The Service, including app design, software, branding, and related materials, is owned by KOLABS Kacper Orzechowski or its licensors and is protected by applicable intellectual property laws.

You receive a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial use, subject to these Terms.

8. Suspension and Termination

We may suspend or terminate access to the Service if:

• You violate these Terms.
• Your use creates risk, legal exposure, or harm to others or the Service.
• We are required to do so by law.

You may stop using the Service at any time.

Termination may result in loss of access to account-related features, including subscription-linked app functionality, subject to platform purchase rules.

9. Disclaimers

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, except where prohibited by law.

To the maximum extent permitted by law, we disclaim implied warranties including merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

To the maximum extent permitted by law:

• KOLABS Kacper Orzechowski and its affiliates, officers, employees, and partners are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages.
• Total liability for claims relating to the Service will not exceed the amount you paid for the Service in the 12 months before the event giving rise to the claim, or USD 50 if you paid nothing, whichever is greater.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

11. Indemnity

You agree to indemnify and hold harmless KOLABS Kacper Orzechowski from claims, liabilities, damages, losses, and expenses arising from your misuse of the Service, your content, or your violation of these Terms or applicable law.

12. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide notice through the app, website, or other reasonable means. Continued use after the effective date of updated Terms means you accept the updated Terms.

13. Governing Law and Dispute Resolution

Governing Law: Poland

Dispute Venue or Method: Any dispute arising out of or in connection with these Terms will be submitted to the competent courts of Poland, unless mandatory consumer protection law in your country of residence provides otherwise.

Where required by law, local consumer protection rights apply and are not waived by these Terms.
